Terms and Conditions

 We operate based on European legislation with registration in the Czech Republic. The following terms and conditions are a translation of the Czech original, which follows this translation.

 

 

I. Basic provisions

1. These General Business Terms (hereinafter referred to as “Business Terms”) are issued pursuant to Section 1751 et seq. of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as “the Civil Code”)

(hereinafter referred to as the "seller")

2. These Terms and Conditions govern the reciprocal rights and obligations of the Seller and the natural person who concludes the Purchase Contract outside of his business activity as a consumer, or within his business activity (hereinafter referred to as the "Buyer") through a web interface located on the website available at the Internet address / (hereinafter referred to as the "Online Shop").

3. The provisions of the Terms and Conditions are an integral part of the Purchase Contract. Different arrangements in the Purchase Contract shall take precedence over the provisions of these Terms and Conditions.

4. These Terms and Conditions and the Purchase Contract are concluded in the Czech language.

 

II. Information about goods and prices

1. Information about goods, including the indication of the prices of individual goods and their main characteristics, is given for individual goods in the catalogue of the online shop. The prices of goods are given including value added tax, all related fees and the costs of returning goods, if by their nature the goods cannot be returned by the usual postal route. The prices of goods remain valid for as long as they are displayed in the online shop. This provision does not preclude the negotiation of a Purchase Contract under individually negotiated terms.

2. All presentations of goods placed in the catalogue of the online shop are informative and the Seller is not obliged to conclude a Purchase Contract for these goods.

3. Information about the costs associated with packaging and delivery of goods is published in the online shop. Information on costs related to packaging and delivery of goods stated in the e-shop is valid only in cases where the goods are delivered within the territory of the Czech Republic.

4. Any discounts on the purchase price of goods cannot be combined with each other unless the seller agrees otherwise with the buyer.

 

III. order and conclusion of the purchase agreement

1. Costs incurred by the buyer when using remote communication means in connection with the conclusion of the purchase agreement (costs of internet connection, costs of telephone calls) are borne by the buyer himself. These costs do not differ from the basic rate.

2. The buyer places the order of goods in the following ways:

  • through his customer account, if he has previously registered in the online store,
  • by filling in the order form without registering. 

3. When placing the order, the buyer chooses the goods, the number of items, the method of payment and the delivery.

4. Before sending the order, the buyer is allowed to check and change the data he has put into the order. The buyer sends the order to the seller by clicking on the "send the order" button. The data given in the order are considered to be correct by the seller. The condition for the validity of the order is the completion of all mandatory data in the order form and the buyer's confirmation that he has become acquainted with these business terms and conditions.

5. Immediately upon receipt of the order, the Seller sends the Purchaser a confirmation of receipt of the order to the email address provided by the Purchaser at the time of ordering. This confirmation is considered to be the conclusion of the contract. The confirmation is attached to the Seller's current terms and conditions. The Purchase Contract is concluded by the Seller's confirmation of the order to the Purchaser's email address.

6. In the event that any of the requirements stated in the order cannot be fulfilled by the Seller, the Seller sends an amended offer to the Purchaser's email address. The amended offer is considered to be a new draft of the Purchase Contract and the Purchase Contract is concluded by the Purchaser's confirmation of receipt of this offer to the Seller's email address stated in these terms and conditions.

7. All orders received by the Seller are binding. The Purchaser may cancel the order until notification of receipt of the order by the Seller is delivered to the Purchaser. The Buyer may cancel the order by telephone to the phone number or email of the Seller specified in these Terms and Conditions.

8. In the event of a manifest technical error on the part of the Seller in the indication of the price of the goods in the online shop, or in the course of ordering, the Seller is not obliged to deliver the goods to the Buyer at this manifestly erroneous price, even if the Buyer was sent an automatic confirmation of receiving the order according to these terms and conditions. The seller informs the buyer of the error without undue delay and sends the buyer an amended offer to his email address. The amended offer is considered as a new draft of the purchase contract and the purchase contract is concluded in such case by confirmation of acceptance by the buyer to the seller's email address.

 

IV. Customer account

1. Based on the buyer's registration in the online store, the buyer can access his customer account. From his customer account, the buyer can order goods. The buyer can also order goods without registration.

2. When registering in the customer account and when ordering goods, the buyer is obliged to provide all data correctly and truthfully. The information provided in the user account is required to be updated by the buyer upon any change. The information provided by the buyer in the customer account and when ordering goods is considered correct by the seller.

3. Access to the customer account is secured by a user name and password. The buyer is obliged to maintain confidentiality regarding the information necessary to access his customer account. The seller is not responsible for any misuse of the customer account by third parties.

4. The buyer is not entitled to allow the use of the customer account by third parties.

5. The seller may cancel the user account, especially if the buyer no longer uses his user account, or if the buyer violates his obligations under the purchase contract or these terms and conditions.

6. The buyer acknowledges that the user account may not be available continuously, especially with regard to the necessary maintenance of the seller's hardware and software equipment, or necessary maintenance of third parties' hardware and software equipment.

 

V. span span style="font-weight: 400;">span style and delivery of goods</span span>

1. The buyer may pay the price of the goods and any costs associated with the delivery of the goods according to the purchase contract in the following ways:

  • by wire transfer to the seller's bank account no. 2801901924/2010, held at Fio Banka a.s.,
  • cashless credit card,
  • wire transfer to the Seller's account via the payment gateway Comgate,
  • cash on delivery,
  • in cash or by credit card upon personal collection at the establishment,
  • in cash or by credit card at the personal collection of the parcel delivery (PPL, GLS, Shipment)

2. Together with the purchase price, the buyer is obliged to reimburse the seller for the costs associated with the packaging and delivery of the goods at the agreed amount. Unless otherwise stated herein, the purchase price and the costs associated with the delivery of the goods are further understood.

3. In the case of cash payment, the purchase price is payable upon receipt of the goods. In the case of cashless payment, the purchase price is payable within 14 days of the conclusion of the purchase contract.

4. In the case of payment through the payment gateway, the buyer follows the instructions of the respective electronic payment provider.[S16] 

5. In the case of cashless payment, the buyer's obligation to reimburse the purchase price is fulfilled when the respective amount is credited to the seller's bank account.

<p="text-align: style;">6. The seller does not require any advance or other similar payment from the buyer in advance. Payment of the purchase price prior to the dispatch of the goods is not an advance payment.

7. According to the Act on the Recording of Sales, the seller is obliged to issue a receipt to the buyer. At the same time, he is obliged to register the received sales with the tax administrator online, in the case of technical failure, then within 48 hours

8. The goods are delivered to the buyer:

  • to the address specified by the buyer to order
  • via the delivery desk to the address specified by the buyer,
  • by personal collection at the seller's premises

9. The choice of the delivery method is made during the ordering of the goods.

10. The costs of delivery of the goods, depending on the method of dispatch and receipt of the goods, are specified in the buyer's order and in the seller's confirmation of the order. If the mode of transport is agreed upon upon a special request of the buyer, the buyer bears the risk and any additional costs associated with this mode of transport.

11. If the seller is obliged to deliver the goods to the place specified by the buyer in the order, the buyer is obliged to take delivery of the goods on delivery. If, for reasons on the part of the buyer, it is necessary to deliver the goods repeatedly or in a different way than stated in the order, the buyer is obliged to pay the costs associated with repeated delivery of the goods or costs associated with another method of delivery.

12. When taking delivery of the goods from the carrier, the buyer is obliged to check the integrity of the packaging of the goods and, in case of any defects, immediately notify the carrier. In case of a finding of a breach of the packaging indicating an unauthorized intrusion into the shipment, the buyer may not take delivery of the shipment from the carrier.

13. The seller issues a tax document to the buyer – an invoice. The tax document is sent to the email address of the buyer.

14. The Purchaser acquires title to the goods by paying the entire purchase price for the goods, including the costs of delivery, but first by taking over the goods. Liability for accidental destruction, damage or loss of goods passes to the buyer at the moment of receipt of the goods or at the moment when the buyer was obliged to take over the goods but did not do so in violation of the purchase contract.

 

VI. Withdrawal from contract

1. The buyer who concluded the purchase contract outside his business activity as a consumer has the right to withdraw from the purchase contract.

2. The withdrawal period is 14 days

  • from the date of receipt of the goods,
  • from the date of receipt of the last delivery of goods if the subject of the contract is several types of goods or the delivery of several parts
  • from the date of receipt of the first delivery of goods if the subject of the contract is the regular repeated delivery of goods.

3. A buyer may not, among other things, withdraw from the sales contract:

  • the provision of services if they have been fulfilled with his prior express consent before the expiry of the withdrawal period and the seller has informed the buyer before the conclusion of the contract that he does not have the right to withdraw from the contract in such a case,
  • the delivery of goods or services the price of which depends on the deviations of the financial market independently of the will of the seller and which may occur during the withdrawal period,
  • on the delivery of alcoholic beverages which may be delivered after thirty days and the price of which depends on the deviations of the financial market independently of the will of the seller,
  • on the delivery of goods which have been modified according to the wishes of the buyer or for his person,
  • on the delivery of perishable goods as well as goods which have been irretrievably mixed with other goods after delivery,
  • on the delivery of goods in sealed packaging which have been removed by the buyer and cannot be returned for reasons of hygiene,
  • on the delivery of an audio or video recording or computer program if it has violated their original packaging,
  • on the delivery of newspapers, periodicals or magazines,
  • delivery of digital content, if it has not been delivered on a material carrier and has been delivered with the buyer's prior express consent before the expiry of the withdrawal period and the seller has informed the buyer prior to the conclusion of the contract that he has no right to withdraw from the contract in such a case,
  • in other cases referred to in Section 1837 of the Civil Code.

4. In order to comply with the withdrawal period, the buyer must send a statement of withdrawal within the withdrawal period.

5. For withdrawal from the purchase contract, the buyer may use the model withdrawal form provided by the seller. The buyer shall send the withdrawal from the purchase contract to the seller's email or delivery address specified in these business conditions. The seller shall confirm receipt of the form to the buyer without delay.

6. The Purchaser who has withdrawn from the Contract shall return the goods to the Seller within 14 days of the withdrawal from the Contract to the Seller. The Purchaser shall bear the costs associated with returning the goods to the Seller, even if the goods cannot be returned due to their nature by the usual postal route.

7. If the Purchaser withdraws from the Contract, the Seller shall return to the Purchaser without delay, but no later than within 14 days of the withdrawal from the Contract, all funds, including delivery costs, received from him in the same manner. The Seller shall return the funds received to the Purchaser by other means only if the Purchaser agrees and if it does not incur additional costs.

span style="font-weight: 400;">8. If the Purchaser has chosen a method other than the cheapest delivery method offered by the Seller, the Seller shall refund to the Purchaser the costs of delivery of the goods in an amount corresponding to the cheapest delivery method offered.

9. If the buyer withdraws from the purchase contract, the seller shall not be obliged to return the received funds to the buyer before the buyer has handed over the goods or proves that he has sent the goods to the seller.

10. The buyer shall return the goods to the seller undamaged, undamaged and unpolluted and, if possible, in the original packaging. The seller shall be entitled to unilaterally set off the claim of the buyer against the buyer's claim for refund of the purchase price.

11. The seller shall be entitled to withdraw from the purchase contract due to the sellout of stock, the unavailability of the goods, or when the manufacturer, importer or supplier of the goods has interrupted the production or import of the goods. The Seller shall promptly inform the Buyer via the email address stated in the order and shall return within 14 days from the notice of withdrawal all funds, including delivery costs, received from him under the contract in the same manner or in a manner specified by the Buyer.

 

VII. rights from defective performance

1. The Seller shall reply to the Buyer that the goods do not have defects upon receipt. In particular, the Seller shall reply to the Buyer that at the time when the Buyer took over the goods:

  • the goods have the characteristics agreed upon by the parties and, in the absence of an arrangement, they have the characteristics that the seller or the manufacturer has described or expected by the buyer, having regard to the nature of the goods and on the basis of advertising by them,
  • the goods fit for the purpose stated by the seller for their use or for which goods of this kind are usually used,
  • the goods correspond to the quality or performance of the agreed sample or presentation, if the quality or performance has been determined according to the agreed sample or presentation,
  • the goods correspond to the quantity, extent or weight and the goods meet the requirements of the legislation.

2. The seller shall be liable for defective performance at least to the extent that the obligations arising from the producer's defective performance persist. The buyer is otherwise entitled to assert a right arising from a defect occurring in consumer goods within twenty-four months of receipt.

3. If the period for which the goods may be used is stated on the goods sold, on their packaging, in the instructions accompanying the goods or in advertising in accordance with other legislation, the provisions on the quality guarantee shall apply. By the quality guarantee, the seller undertakes that the goods will be fit for use for the usual purpose for a certain period of time or that they will retain the usual characteristics. If the buyer justifiably accuses the seller of a defect in the goods, the period for asserting the rights arising from defective performance or the guarantee period shall not run for the period during which the buyer cannot use the defective goods.

4. The provisions referred to in the preceding paragraph of the Terms and Conditions shall not apply to goods sold at a lower price to defects for which a lower price has been agreed, to wear and tear of the goods caused by their normal use, to used goods to defects corresponding to the degree of use or wear which the goods had when they were taken over by the buyer, or if this results from the nature of the goods. The right of defective performance does not belong to the buyer if he knew before taking over the goods that the goods had a defect, or if the defect was caused by the buyer himself.

5. In the event of a defect, the buyer may submit a complaint to the seller and request:

  • exchange for new goods,
  • repair of goods,
  • a reasonable discount on the purchase price,
  • withdraw from the contract.

6. The Buyer has the right to withdraw from the contract:

  • if the goods have a substantial defect,
  • if the goods cannot be properly used for repeated occurrence of defect or defects after repair,
  • with multiple defects of the goods.

7. Significant is such a breach of contract of which the party violating the contract already knew at the time of entering into the contract or must have known that the other party would not have entered into the contract if it had foreseen such a breach.

8. For a defect that constitutes a minor breach of contract (regardless of whether the defect is removable or non-removable), the buyer is entitled to have the defect removed or a reasonable discount on the purchase price.

9. If the removable defect has occurred repeatedly after repair (usually a third complaint for the same defect or a fourth complaint for different defects) or the goods have a greater number of defects (usually at least three defects at the same time), the buyer is entitled to claim a discount on the purchase price, exchange the goods or withdraw from the contract.

10. When making a claim, the buyer is obliged to tell the seller what right he has chosen. A change of choice without the seller's consent is only possible if the buyer has asked for a repair of a defect that turns out to be non-removable. If the buyer does not choose his right from a substantial breach of contract in time, his rights are the same as for a minor breach.

11. If repair or exchange of the goods is not possible, on the basis of withdrawal from the contract, the buyer may demand a refund of the purchase price in full.

12. If the seller proves that the buyer knew or caused the defect of the goods before taking over, the seller is not obliged to comply with the buyer's claim.

13. The buyer cannot claim the discounted goods because of the reason for which the goods are discounted.

14. The seller is obliged to accept the complaint at any establishment where acceptance of the complaint is possible, or at the registered office or place of business. The seller is obliged to issue the buyer with a written confirmation of when the buyer has asserted the right, what is the content of the complaint and what manner of settlement of the complaint the buyer requires, as well as confirmation of the date and manner of settlement of the complaint, including confirmation of the repair and its duration, or a written justification of the rejection of the complaint.

<p="text-align: style;">15. The seller or his authorized employee decides on the complaint immediately, in complex cases within three working days. This period does not include a reasonable period of time, depending on the type of product or service, needed for an expert assessment of the defect. The complaint, including the removal of the defect, must be settled promptly, at the latest within 30 days from the date of the claim, unless the seller agrees with the buyer on a longer period. The futile expiry of this period is considered a material breach of the contract and the buyer has the right to withdraw from the purchase contract. The moment of the claim is considered the moment when the buyer's will (exercise of the right from defective performance) reaches the seller. <p="text-align: style;">16. The seller informs the buyer in writing about the result of the complaint.

17. The right from defective performance does not belong to the buyer if the buyer knew before taking over the item that the item had a defect, or if the buyer caused the defect himself.

<p="text-align: style;">18. In the case of a justified complaint, the buyer has the right to reimburse expediently incurred costs incurred in connection with the claim. This right can be exercised by the buyer with the seller within a period of one month after the expiry of the guarantee period, otherwise the court may not grant it.

19. The buyer has the choice of the complaint method.

20. The rights and obligations of the contracting parties regarding rights from defective performance are governed by Sections 1914 to 1925, Sections 2099 to 2117 and Sections 2161 to 2174 of the Civil Code and by Act No.634/1992 Coll., on Consumer Protection.

21. Other rights and obligations of the parties related to the seller's liability for defects are governed by the seller's complaints procedure.

 

VIII. Delivery

1. The Contracting Parties may deliver all written correspondence to each other by e-mail.

2. The Buyer delivers correspondence to the Seller to the e-mail address specified in these Terms and Conditions. The Seller delivers correspondence to the Buyer to the e-mail address specified in its customer account or order.

 

IX. </span span>span style="font-weight: 400;">Personal Data

1. All information you provide in our cooperation is confidential and will be treated as such. If you do not give us written permission to do so, we will not use your data in any way other than for the purpose of fulfilling the contract, except for the e-mail address to which business communications may be sent to you, as this procedure is permitted by law unless you reject it. These communications may only concern similar or related goods and can be cancelled at any time in a simple manner (by sending a letter, email or clicking on a link in the commercial communication). The email address will be kept for this purpose for 3 years from the conclusion of the last contract between the parties.

X. span style="font-weight: 400;">Out-of-court dispute resolution

1. The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Praha 2, ID: 000 20 869, internet address: https://adr.coi.cz/en. The online dispute resolution platform located at http://ec.europa.eu/consumers/odr can be used to resolve disputes between the seller and the buyer from the purchase contract.

2. European Consumer Centre Czech Republic, with its registered office at Štěpánská 567/15, 120 00 Praha 2, internet address: http://www.evropskyspotrebitel.cz is the contact point under Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on the online resolution of consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on the online resolution of consumer disputes).

3. The seller is entitled to sell goods on the basis of a trade license. The trade inspection is carried out by the competent trade licensing authority within its competence. The Czech Trade Inspection Authority performs, among other things, the supervision of compliance with Act No 634/1992 Coll., on consumer protection, within the defined scope.

 

XI. Final Provisions

1. All agreements between the seller and the buyer with the legal order of the Czech Republic. If the relationship established by the purchase contract contains an international element, then the parties agree that the relationship is governed by the law of the Czech Republic. This is without prejudice to the rights of the consumer arising from generally binding legal regulations.

2. The seller is not bound in relation to the buyer by any codes of conduct within the meaning of the provisions of § 1826 para. 1 letter e) of the Civil Code.

3. All rights to the Seller's website, in particular copyright to content, including page layout, photos, films, graphics, trademarks, logos and other content and features, belong to the Seller. It is forbidden to copy, modify or otherwise use the website or a part thereof without the consent of the seller.

4. The Seller shall not be liable for errors resulting from interference by third parties in the Online Shop or from its use contrary to its designation. When using an online store, the buyer shall not use procedures that could have a negative effect on its operation and shall not engage in any activity that could allow him or third parties to tamper with or unauthorized use of the software or other components constituting the online store and to use the online store or parts thereof or software equipment in a manner that would conflict with its purpose or purpose.

5. The Buyer hereby assumes the risk of changing circumstances within the meaning of § 1765 para. 2 of the Civil Code.

6. The sales contract including the terms and conditions is archived by the seller in electronic form and is not accessible.

7. The seller may change or supplement the terms and conditions. This provision is without prejudice to rights and obligations arising during the period of effect of the previous version of the terms and conditions.

8. The annex to the terms and conditions is a model form for withdrawal from the contract.

(dále jen „prodávající“)

2. Tyto obchodní podmínky upravují vzájemná práva a povinnosti prodávajícího a fyzické osoby, která uzavírá kupní smlouvu mimo svoji podnikatelskou činnost jako spotřebitel, nebo v rámci své podnikatelské činnosti (dále jen: „kupující“) prostřednictvím webového rozhraní umístěného na webové stránce dostupné na internetové adrese / . (dále je „internetový obchod“).

3. Ustanovení obchodních podmínek jsou nedílnou součástí kupní smlouvy. Odchylná ujednání v kupní smlouvě mají přednost před ustanoveními těchto obchodních podmínek.

4. Tyto obchodní podmínky a kupní smlouva se uzavírají v českém jazyce.

 

II. Informace o zboží a cenách

1. Informace o zboží, včetně uvedení cen jednotlivého zboží a jeho hlavních vlastností jsou uvedeny u jednotlivého zboží v katalogu internetového obchodu. Ceny zboží jsou uvedeny včetně daně z přidané hodnoty, všech souvisejících poplatků a nákladů za vrácení zboží, jestliže toto zboží ze své podstaty nemůže být vráceno obvyklou poštovní cestou. Ceny zboží zůstávají v platnosti po dobu, po kterou jsou zobrazovány v internetovém obchodě. Toto ustanovení nevylučuje sjednání kupní smlouvy za individuálně sjednaných podmínek.

2. Veškerá prezentace zboží umístěná v katalogu internetového obchodu je informativního charakteru a prodávající není povinen uzavřít kupní smlouvu ohledně tohoto zboží.

3. V internetovém obchodě jsou zveřejněny informace o nákladech spojených s balením a dodáním zboží. Informace o nákladech spojených s balením a dodáním zboží uvedené v internetovém obchodě platí pouze v případech, kdy je zboží doručováno v rámci území České republiky.

4. Případné slevy z kupní ceny zboží nelze navzájem kombinovat, nedohodne-li se prodávající s kupujícím jinak.

 

III. Objednávka a uzavření kupní smlouvy

1. Náklady vzniklé kupujícímu při použití komunikačních prostředků na dálku v souvislosti s uzavřením kupní smlouvy (náklady na internetové připojení, náklady na telefonní hovory), hradí kupující sám. Tyto náklady se neliší od základní sazby.

2. Kupující provádí objednávku zboží těmito způsoby:

  • prostřednictvím svého zákaznického účtu, provedl-li předchozí registraci v internetovém obchodě,
  • vyplněním objednávkového formuláře bez registrace.  

3. Při zadávání objednávky si kupující vybere zboží, počet kusů zboží, způsob platby a doručení.

4. Před odesláním objednávky je kupujícímu umožněno kontrolovat a měnit údaje, které do objednávky vložil. Objednávku odešle kupující prodávajícímu kliknutím na tlačítko "odeslat objednávku". Údaje uvedené v objednávce jsou prodávajícím považovány za správné. Podmínkou platnosti objednávky je vyplnění všech povinných údajů v objednávkovém formuláři a potvrzení kupujícího o tom, že se seznámil s těmito obchodními podmínkami.

5. Neprodleně po obdržení objednávky zašle prodávající kupujícímu potvrzení o obdržení objednávky na emailovou adresu, kterou kupující při objednání zadal. Toto potvrzení se považuje za uzavření smlouvy. Přílohou potvrzení jsou aktuální obchodní podmínky prodávajícího. Kupní smlouva je uzavřena potvrzením objednávky prodávajícím na emailovou adresu kupujícího.

6. V případě, že některý z požadavků uvedených v objednávce nemůže prodávající splnit, zašle kupujícímu na jeho emailovou adresu pozměněnou nabídku. Pozměněná nabídka se považuje za nový návrh kupní smlouvy a kupní smlouva je v takovém případě uzavřena potvrzením kupujícího o přijetí této nabídky prodávajícímu na jeho emailovou adresu uvedenu v těchto obchodních podmínkách.

7. Všechny objednávky přijaté prodávajícím jsou závazné. Kupující může zrušit objednávku, dokud není kupujícímu doručeno oznámení o přijetí objednávky prodávajícím. Kupující může zrušit objednávku telefonicky na telefonní číslo nebo email prodávajícího uvedený v těchto obchodních podmínkách.

8. V případě, že došlo ke zjevné technické chybě na straně prodávajícího při uvedení ceny zboží v internetovém obchodě, nebo v průběhu objednávání, není prodávající povinen dodat kupujícímu zboží za tuto zcela zjevně chybnou cenu ani v případě, že kupujícímu bylo zasláno automatické potvrzení o obdržení objednávky podle těchto obchodních podmínek. Prodávající informuje kupujícího o chybě bez zbytečného odkladu a zašle kupujícímu na jeho emailovou adresu pozměněnou nabídku. Pozměněná nabídka se považuje za nový návrh kupní smlouvy a kupní smlouva je v takovém případě uzavřena potvrzením o přijetí kupujícím na emailovou adresu prodávajícího.

 

IV. Zákaznický účet

1. Na základě registrace kupujícího provedené v internetovém obchodě může kupující přistupovat do svého zákaznického účtu. Ze svého zákaznického účtu může kupující provádět objednávání zboží. Kupující může objednávat zboží také bez registrace.

2. Při registraci do zákaznického účtu a při objednávání zboží je kupující povinen uvádět správně a pravdivě všechny údaje. Údaje uvedené v uživatelském účtu je kupující při jakékoliv jejich změně povinen aktualizovat. Údaje uvedené kupujícím v zákaznickém účtu a při objednávání zboží jsou prodávajícím považovány za správné.

3. Přístup k zákaznickému účtu je zabezpečen uživatelským jménem a heslem. Kupující je povinen zachovávat mlčenlivost, ohledně informací nezbytných k přístupu do jeho zákaznického účtu. Prodávající nenese odpovědnost za případné zneužití zákaznického účtu třetími osobami.

4. Kupující není oprávněn umožnit využívání zákaznického účtu třetím osobám.

5. Prodávající může zrušit uživatelský účet, a to zejména v případě, když kupující svůj uživatelský účet déle nevyužívá, či v případě, kdy kupující poruší své povinnosti z kupní smlouvy nebo těchto obchodních podmínek.

6. Kupující bere na vědomí, že uživatelský účet nemusí být dostupný nepřetržitě, a to zejména s ohledem na nutnou údržbu hardwarového a softwarového vybavení prodávajícího, popř. nutnou údržbu hardwarového a softwarového vybavení třetích osob.

 

V. Platební podmínky a dodání zboží

1. Cenu zboží a případné náklady spojené s dodáním zboží dle kupní smlouvy může kupující uhradit následujícími způsoby:

  • bezhotovostně převodem na bankovní účet prodávajícího č. 2801901924/2010, vedený u Fio Banka a.s.,
  • bezhotovostně platební kartou,
  • bezhotovostně převodem na účet prodávajícího prostřednictvím platební brány Comgate,
  • dobírkou v hotovosti při předání zboží,
  • v hotovosti nebo platební kartou při osobním odběru v provozovně,
  • v hotovosti nebo platební kartou při osobním odběru výdejně zásilek (PPL, GLS, Zásilkovna)

2. Společně s kupní cenou je kupující povinen uhradit prodávajícímu náklady spojené s balením a dodáním zboží ve smluvené výši. Není-li dále uvedeno výslovně jinak, rozumí se dále kupní cenou i náklady spojené s dodáním zboží.

3. V případě platby v hotovosti je kupní cena splatná při převzetí zboží. V případě bezhotovostní platby je kupní cena splatná do 14ti dnů od uzavření kupní smlouvy.

4. V případě platby prostřednictvím platební brány postupuje kupující podle pokynů příslušného poskytovatele elektronických plateb.[S16] 

5. V případě bezhotovostní platby je závazek kupujícího uhradit kupní cenu splněn okamžikem připsání příslušné částky na bankovní účet prodávajícího.

6. Prodávající nepožaduje od kupujícího předem žádnou zálohu či jinou obdobnou platbu. Úhrada kupní ceny před odesláním zboží není zálohou.

7. Podle zákona o evidenci tržeb je prodávající povinen vystavit kupujícímu účtenku. Zároveň je povinen zaevidovat přijatou tržbu u správce daně online, v případě technického výpadku pak nejpozději do 48 hodin

8. Zboží je kupujícímu dodáno:

  • na adresu určenou kupujícím objednávce
  • prostřednictvím výdejny zásilek na adresu výdejny, kterou kupující určil,
  • osobním odběrem v provozovně prodávajícího

9. Volba způsobu dodání se provádí během objednávání zboží.

10. Náklady na dodání zboží v závislosti na způsobu odeslání a převzetí zboží jsou uvedeny v objednávce kupujícího a v potvrzení objednávky prodávajícím. V případě, že je způsob dopravy smluven na základě zvláštního požadavku kupujícího, nese kupující riziko a případné dodatečné náklady spojené s tímto způsobem dopravy.

11. Je-li prodávající podle kupní smlouvy povinen dodat zboží na místo určené kupujícím v objednávce, je kupující povinen převzít zboží při dodání. V případě, že je z důvodů na straně kupujícího nutno zboží doručovat opakovaně nebo jiným způsobem, než bylo uvedeno v objednávce, je kupující povinen uhradit náklady spojené s opakovaným doručováním zboží, resp. náklady spojené s jiným způsobem doručení.

12. Při převzetí zboží od přepravce je kupující povinen zkontrolovat neporušenost obalů zboží a v případě jakýchkoliv závad toto neprodleně oznámit přepravci. V případě shledání porušení obalu svědčícího o neoprávněném vniknutí do zásilky nemusí kupující zásilku od přepravce převzít.

13. Prodávající vystaví kupujícímu daňový doklad – fakturu. Daňový doklad je odeslán na emailovou adresu kupujícího.

14. Kupující nabývá vlastnické právo ke zboží zaplacením celé kupní ceny za zboží, včetně nákladů na dodání, nejdříve však převzetím zboží. Odpovědnost za nahodilou zkázu, poškození či ztrátu zboží přechází na kupujícího okamžikem převzetí zboží nebo okamžikem, kdy měl kupující povinnost zboží převzít, ale v rozporu s kupní smlouvou tak neučinil.

 

VI. Odstoupení od smlouvy

1. Kupující, který uzavřel kupní smlouvu mimo svoji podnikatelskou činnost jako spotřebitel, má právo od kupní smlouvy odstoupit.

2. Lhůta pro odstoupení od smlouvy činí 14 dnů

  • ode dne převzetí zboží,
  • ode dne převzetí poslední dodávky zboží, je-li předmětem smlouvy několik druhů zboží nebo dodání několika částí
  • ode dne převzetí první dodávky zboží, je-li předmětem smlouvy pravidelná opakovaná dodávka zboží.

3. Kupující nemůže mimo jiné odstoupit od kupní smlouvy:

  • poskytování služeb, jestliže byly splněny s jeho předchozím výslovným souhlasem před uplynutím lhůty pro odstoupení od smlouvy a prodávající před uzavřením smlouvy sdělil kupujícímu, že v takovém případě nemá právo na odstoupení od smlouvy,
  • o dodávce zboží nebo služby, jejichž cena závisí na výchylkách finančního trhu nezávisle na vůli prodávajícího a k němuž může dojít během lhůty pro odstoupení od smlouvy,
  • o dodání alkoholických nápojů, jež mohou být dodány až po uplynutí třiceti dnů a jejichž cena závisí na výchylkách finančního trhu nezávislých na vůli prodávajícího,
  • o dodávce zboží, které bylo upraveno podle přání kupujícího nebo pro jeho osobu,
  • dodávce zboží, které podléhá rychlé zkáze, jakož i zboží, které bylo po dodání nenávratně smíseno s jiným zbožím,
  • dodávce zboží v uzavřeném obalu, které kupující z obalu vyňal a z hygienických důvodů jej není možné vrátit,
  • dodávce zvukové nebo obrazové nahrávky nebo počítačového programu, pokud porušil jejich původní obal,
  • dodávce novin, periodik nebo časopisů,
  • dodání digitálního obsahu, pokud nebyl dodán na hmotném nosiči a byl dodán s předchozím výslovným souhlasem kupujícího před uplynutím lhůty pro odstoupení od smlouvy a prodávající před uzavřením smlouvy sdělil kupujícímu, že v takovém případě nemá právo na odstoupení od smlouvy,
  • v dalších případech uvedených v § 1837 občanského zákoníku.

4. Pro dodržení lhůty pro odstoupení od smlouvy musí kupující odeslat prohlášení o odstoupení ve lhůtě pro odstoupení od smlouvy.

5. Pro odstoupení od kupní smlouvy může kupující využít vzorový formulář k odstoupení od smlouvy poskytovaný prodávajícím. Odstoupení od kupní smlouvy zašle kupující na emailovou nebo doručovací adresu prodávajícího uvedenou v těchto obchodních podmínkách. Prodávající potvrdí kupujícímu bezodkladně přijetí formuláře.

6. Kupující, který odstoupil od smlouvy, je povinen vrátit prodávajícímu zboží do 14 dnů od odstoupení od smlouvy prodávajícímu. Kupující nese náklady spojené s navrácením zboží prodávajícímu, a to i v tom případě, kdy zboží nemůže být vráceno pro svou povahu obvyklou poštovní cestou.

7. Odstoupí-li kupující od smlouvy, vrátí mu prodávající bezodkladně, nejpozději však do 14 dnů od odstoupení od smlouvy, všechny peněžní prostředky včetně nákladů na dodání, které od něho přijal, a to stejným způsobem. Prodávající vrátí kupujícímu přijaté peněžní prostředky jiným způsobem jen tehdy, pokud s tím kupující souhlasí a pokud mu tím nevzniknou další náklady.

8. Jestliže kupující zvolil jiný, než nejlevnější způsob dodání zboží, který prodávající nabízí, vrátí prodávající kupujícímu náklady na dodání zboží ve výši odpovídající nejlevnějšímu nabízenému způsobu dodání zboží.

9. Odstoupí-li kupující od kupní smlouvy, není prodávající povinen vrátit přijaté peněžní prostředky kupujícímu dříve, než mu kupující zboží předá nebo prokáže, že zboží prodávajícímu odeslal.

10. Zboží musí vrátit kupující prodávajícímu nepoškozené, neopotřebené a neznečištěné a je-li to možné, v původním obalu. Nárok na náhradu škody vzniklé na zboží je prodávající oprávněn jednostranně započíst proti nároku kupujícího na vrácení kupní ceny.

11. Prodávající je oprávněn odstoupit od kupní smlouvy z důvodu vyprodání zásob, nedostupnosti zboží, anebo když výrobce, dovozce anebo dodavatel zboží přerušil výrobu nebo dovoz zboží. Prodávající bezodkladně informuje kupujícího prostřednictví emailové adresy uvedené v objednávce a vrátí ve lhůtě 14 dnů od oznámení o odstoupení od kupní smlouvy všechny peněžní prostředky včetně nákladů na dodání, které od něho na základě smlouvy přijal, a to stejným způsobem, popřípadě způsobem určeným kupujícím.

 

VII. Práva z vadného plnění

1. Prodávající odpovídá kupujícímu, že zboží při převzetí nemá vady. Zejména prodávající odpovídá kupujícímu, že v době, kdy kupující zboží převzal:

  • má zboží vlastnosti, které si strany ujednaly, a chybí-li ujednání, má takové vlastnosti, které prodávající nebo výrobce popsal nebo které kupující očekával s ohledem na povahu zboží a na základě reklamy jimi prováděné,
  • se zboží hodí k účelu, který pro jeho použití prodávající uvádí nebo ke kterému se zboží tohoto druhu obvykle používá,
  • zboží odpovídá jakostí nebo provedením smluvenému vzorku nebo předloze, byla-li jakost nebo provedení určeno podle smluveného vzorku nebo předlohy,
  • je zboží v odpovídajícím množství, míře nebo hmotnosti a zboží vyhovuje požadavkům právních předpisů.

2. Povinnosti z vadného plnění má prodávající nejméně v takovém rozsahu, v jakém trvají povinnosti z vadného plnění výrobce. Kupující je jinak oprávněn uplatnit právo z vady, která se vyskytne u spotřebního zboží v době dvaceti čtyř měsíců od převzetí.

3. Je-li na prodávaném zboží, na jeho obalu, v návodu připojenému ke zboží nebo v reklamě v souladu s jinými právními předpisy uvedena doba, po kterou lze zboží použít, použijí se ustanovení o záruce za jakost. Zárukou za jakost se prodávající zavazuje, že zboží bude po určitou dobu způsobilé k použití pro obvyklý účel nebo že si zachová obvyklé vlastnosti. Vytkl-li kupující prodávajícímu vadu zboží oprávněně, neběží lhůta pro uplatnění práv z vadného plnění ani záruční doba po dobu, po kterou nemůže kupující vadné zboží užívat.

4. Ustanovení uvedená v předchozím odstavci obchodních podmínek se nepoužijí u zboží prodávaného za nižší cenu na vadu, pro kterou byla nižší cena ujednána, na opotřebení zboží způsobené jeho obvyklým užíváním, u použitého zboží na vadu odpovídající míře používání nebo opotřebení, kterou zboží mělo při převzetí kupujícím, nebo vyplývá-li to z povahy zboží. Právo z vadného plnění kupujícímu nenáleží, pokud před převzetím zboží věděl, že zboží má vadu, anebo pokud vadu sám kupující způsobil.

5. V případě výskytu vady může kupující prodávajícímu předložit reklamaci a požadovat:

  • výměnu za nové zboží,
  • opravu zboží,
  • přiměřenou slevu z kupní ceny,
  • odstoupit od smlouvy.

6. Kupující má právo odstoupit od smlouvy:

  • pokud má zboží podstatnou vadu,
  • pokud nemůže věc řádně užívat pro opakovaný výskyt vady nebo vad po opravě,
  • při větším počtu vad zboží.

7. Podstatné je takové porušení smlouvy, o němž strana porušující smlouvu již při uzavření smlouvy věděla nebo musela vědět, že by druhá strana smlouvu neuzavřela, pokud by toto porušení předvídala.

8. U vady, která znamená nepodstatné porušení smlouvy (bez ohledu na to, jde-li o vadu odstranitelnou či neodstranitelnou), má kupující nárok na odstranění vady anebo přiměřenou slevu z kupní ceny.

9. Vyskytla-li se odstranitelná vada po opravě opakovaně (obvykle třetí reklamace pro stejnou závadu nebo čtvrtá pro odlišné závady) nebo má zboží větší počet vad (zpravidla nejméně tři vady současně), má kupující právo uplatnit požadavek na slevu z kupní ceny, výměnu zboží nebo odstoupit od smlouvy.

10. Při uplatnění reklamace je kupující povinen prodávajícímu sdělit, jaké právo si zvolil. Změna volby bez souhlasu prodávajícího je možná jen tehdy, žádal-li kupující opravu vady, která se ukáže být neodstranitelná. Nezvolí-li kupující si své právo z podstatného porušení smlouvy včas, má práva stejná jako při nepodstatném porušení smlouvy.

11. Není-li oprava nebo výměna zboží možná, na základě odstoupení od smlouvy může kupující požadovat vrácení kupní ceny v plné výši.

12. Pokud prodávající prokáže, že kupující před převzetím o vadě zboží věděl nebo ji sám způsobil, není prodávající povinen nároku kupujícího vyhovět.

13. Kupující nemůže reklamovat zlevněné zboží z důvodu, pro který je dané zboží zlevněno.

14. Prodávající je povinen přijmout reklamaci v kterékoli provozovně, v níž je přijetí reklamace možné, případně i v sídle nebo místě podnikání. Prodávající je povinen kupujícímu vydat písemné potvrzení o tom, kdy kupující právo uplatnil, co je obsahem reklamace a jaký způsob vyřízení reklamace kupující požaduje, jakož i potvrzení o datu a způsobu vyřízení reklamace, včetně potvrzení o provedení opravy a době jejího trvání, případně písemné odůvodnění zamítnutí reklamace.

15. Prodávající nebo jím pověřený pracovník rozhodne o reklamaci ihned, ve složitých případech do tří pracovních dnů. Do této lhůty se nezapočítává doba přiměřená podle druhu výrobku či služby potřebná k odbornému posouzení vady. Reklamace včetně odstranění vady musí být vyřízena bezodkladně, nejpozději do 30 dnů ode dne uplatnění reklamace, pokud se prodávající s kupujícím nedohodne na delší lhůtě. Marné uplynutí této lhůty se považuje za podstatné porušení smlouvy a kupující má právo od kupní smlouvy odstoupit. Za okamžik uplatnění reklamace se považuje okamžik, kdy dojde projev vůle kupujícího (uplatnění práva z vadného plnění) prodávajícímu.

16. Prodávající písemně informuje kupujícího o výsledku reklamace.

17. Právo z vadného plnění kupujícímu nenáleží, pokud kupující před převzetím věci věděl, že věc má vadu, anebo pokud kupující vadu sám způsobil.

18. V případě oprávněné reklamace má kupující právo na náhradu účelně vynaložených nákladů vzniklých v souvislosti s uplatněním reklamace. Toto právo může kupující u prodávajícího uplatnit ve lhůtě do jednoho měsíce po uplynutí záruční doby, v opačném případě ho soud nemusí přiznat.

19. Volbu způsobu reklamace má kupující.

20. Práva a povinnosti smluvních stran ohledně práv z vadného plnění se řídí § 1914 až 1925, § 2099 až 2117 a § 2161 až 2174 občanského zákoníku a zákonem č. 634/1992 Sb., o ochraně spotřebitele.

21. Další práva a povinnosti stran související s odpovědností prodávajícího za vady upravuje reklamační řád prodávajícího.

 

VIII. Doručování

1. Smluvní strany si mohou veškerou písemnou korespondenci vzájemně doručovat prostřednictvím elektronické pošty.

2. Kupující doručuje prodávajícímu korespondenci na emailovou adresu uvedenou v těchto obchodních podmínkách. Prodávající doručuje kupujícímu korespondenci na emailovou adresu uvedenou v jeho zákaznickém účtu nebo v objednávce.

 

IX. Osobní údaje

1. Všechny informace, které při naší spolupráci uvedete, jsou důvěrné a budeme s nimi tak zacházet. Pokud nám k tomu nedáte písemné svolení, údaje o vás nebudeme jiným způsobem než za účelem plnění ze smlouvy používat, vyjma emailové adresy, na kterou vám mohou být zasílána obchodní sdělení, neboť tento postup umožňuje zákon, pokud jej neodmítnete. Tato sdělení se mohou týkat pouze obdobného nebo souvisejícího zboží a lze je kdykoliv jednoduchým způsobem (zasláním dopisu, emailu nebo proklikem na odkaz v obchodním sdělení) odhlásit. Emailová adresa bude za tímto účelem uchovávána po dobu 3 let od uzavření poslední smlouvy mezi smluvními stranami.

X. Mimosoudní řešení sporů

1. K mimosoudnímu řešení spotřebitelských sporů z kupní smlouvy je příslušná Česká obchodní inspekce, se sídlem Štěpánská 567/15, 120 00 Praha 2, IČ: 000 20 869, internetová adresa: https://adr.coi.cz/cs. Platformu pro řešení sporů on-line nacházející se na internetové adrese http://ec.europa.eu/consumers/odr je možné využít při řešení sporů mezi prodávajícím a kupujícím z kupní smlouvy.

2. Evropské spotřebitelské centrum Česká republika, se sídlem Štěpánská 567/15, 120 00 Praha 2, internetová adresa: http://www.evropskyspotrebitel.cz je kontaktním místem podle Nařízení Evropského parlamentu a Rady (EU) č. 524/2013 ze dne 21. května 2013 o řešení spotřebitelských sporů on-line a o změně nařízení (ES) č. 2006/2004 a směrnice 2009/22/ES (nařízení o řešení spotřebitelských sporů on-line).

3. Prodávající je oprávněn k prodeji zboží na základě živnostenského oprávnění. Živnostenskou kontrolu provádí v rámci své působnosti příslušný živnostenský úřad. Česká obchodní inspekce vykonává ve vymezeném rozsahu mimo jiné dozor nad dodržováním zákona č. 634/1992 Sb., o ochraně spotřebitele.

 

XI. Závěrečná ustanovení

1. Veškerá ujednání mezi prodávajícím a kupujícím se právním řádem České republiky. Pokud vztah založený kupní smlouvou obsahuje mezinárodní prvek, pak strany sjednávají, že vztah se řídí právem České republiky. Tímto nejsou dotčena práva spotřebitele vyplývající z obecně závazných právních předpisů.

2. Prodávající není ve vztahu ke kupujícímu vázán žádnými kodexy chování ve smyslu ustanovení § 1826 odst. 1 písm. e) občanského zákoníku.

3. Všechna práva k webovým stránkám prodávajícího, zejména autorská práva k obsahu, včetně rozvržení stránky, fotek, filmů, grafik, ochranných známek, loga a dalšího obsahu a prvků, náleží prodávajícímu. Je zakázáno kopírovat, upravovat nebo jinak používat webové stránky nebo jejich část bez souhlasu prodávajícího.

4. Prodávající nenese odpovědnost za chyby vzniklé v důsledku zásahů třetích osob do internetového obchodu nebo v důsledku jeho užití v rozporu s jeho určením. Kupující nesmí při využívání internetového obchodu používat postupy, které by mohly mít negativní vliv na jeho provoz a nesmí vykonávat žádnou činnost, která by mohla jemu nebo třetím osobám umožnit neoprávněně zasahovat či neoprávněně užít programové vybavení nebo další součásti tvořící internetový obchod a užívat internetový obchod nebo jeho části či softwarové vybavení takovým způsobem, který by byl v rozporu s jeho určením či účelem.

5. Kupující tímto přebírá na sebe nebezpečí změny okolností ve smyslu § 1765 odst. 2 občanského zákoníku.

6. Kupní smlouva včetně obchodních podmínek je archivována prodávajícím v elektronické podobě a není přístupná.

7. Znění obchodních podmínek může prodávající měnit či doplňovat. Tímto ustanovením nejsou dotčena práva a povinnosti vzniklá po dobu účinnosti předchozího znění obchodních podmínek.

8. Přílohou obchodních podmínek je vzorový formulář pro odstoupení od smlouvy.
